1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the website at sammu.co and the Sammu AI phone agent platform (collectively, the "Service") operated by Sammu ("we", "us", or "our").

By accessing or using the Service, creating an account, or clicking "Get Started" or any equivalent button, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

If you are using the Service on behalf of a business or organisation, you represent and warrant that you have the authority to bind that entity to these Terms.

2. Eligibility

You may use the Service only if you:

  • Are at least 18 years of age.
  • Have the legal capacity to enter into a binding contract.
  • Are not barred from using the Service under applicable law.

We reserve the right to refuse access to any person or entity at our sole discretion.

3. The Service

Sammu provides an AI-powered phone agent platform that allows businesses to build, deploy, and manage automated voice agents for handling inbound phone calls. Features include agent configuration, knowledge base management, third-party integrations, call analytics, sentiment analysis, and issue labeling.

We reserve the right to modify, suspend, or discontinue the Service or any part of it at any time with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

4. Accounts

To access core features of the Service, you must create an account using a valid business email address. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account.
  • Notifying us immediately at Support@sammu.co if you suspect unauthorised access.

We are not liable for any loss or damage arising from your failure to safeguard your account credentials.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights.
  • Conduct unsolicited outbound calling campaigns or spam.
  • Impersonate any person, business, or entity in a misleading or deceptive manner.
  • Collect or process personal data without appropriate legal basis or consent.
  • Transmit harmful, abusive, hateful, or obscene content.
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure.
  • Reverse engineer, decompile, or extract the underlying AI models or source code.
  • Resell or sublicense access to the Service without our prior written consent.
  • Use the Service in any way that could damage, disable, or impair its operation.

We reserve the right to suspend or terminate accounts that violate this section without prior notice.

6. Your Content

You retain ownership of all documents, FAQs, recordings, scripts, and other content you upload or provide to the Service ("Your Content"). By uploading Your Content, you grant Sammu a non-exclusive, worldwide, royalty-free licence to use, process, and store it solely to provide and improve the Service.

You represent and warrant that:

  • You have all rights necessary to grant the above licence.
  • Your Content does not infringe any third-party intellectual property rights.
  • Your Content complies with all applicable laws, including those governing the recording and processing of phone calls and personal data.

You are solely responsible for obtaining any consents required by law before recording calls handled by the Service.

7. Intellectual Property

The Service, including its software, AI models, design, text, graphics, and all other content created by Sammu, is owned by or licensed to Sammu and protected by intellectual property laws. Nothing in these Terms transfers any ownership of Sammu's intellectual property to you.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service strictly in accordance with these Terms.

8. Payment and Billing

Certain features of the Service are subject to fees as described in our pricing plans. By selecting a paid plan, you authorise us to charge your payment method on the applicable billing cycle. All fees are non-refundable unless otherwise stated or required by law.

We reserve the right to change pricing at any time. We will provide reasonable notice of any price changes. Continued use of the Service after the effective date of a price change constitutes acceptance of the new pricing.

If payment fails, we may suspend access to the Service until outstanding amounts are settled.

9. Termination

You may terminate your account at any time by contacting us at Support@sammu.co. We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice.

Upon termination, your right to use the Service ceases immediately. We may retain your data for a period required by law or our data retention policy, after which it will be deleted. Sections of these Terms that by their nature should survive termination will do so, including Sections 6, 7, 10, 11, and 12.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. AI-generated responses may occasionally be inaccurate — you are responsible for reviewing and validating the output of your AI agent before relying on it for business decisions.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SAMMU AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO SAMMU IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

12. Indemnification

You agree to indemnify, defend, and hold harmless Sammu and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights or applicable law.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation in the first instance. If a dispute cannot be resolved informally, it shall be submitted to the competent courts of the jurisdiction in which Sammu is registered.

14. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted at sammu.co/terms with an updated "Last updated" date. For material changes, we will make reasonable efforts to notify you (for example, by email or a notice within the dashboard). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
